The Freedom of Information Act 1982 (Vic) (FOI Act) gives you the right to request access to a range of  documents held by the Victorian Inspectorate (VI).

How to make a request

Before you make a request, please note that the section 102 of the Victorian Inspectorate Act 2011 (VI Act) establishes that FOI Act does not apply to a document that is in the possession of the VI or VI officer to the extent to which the document discloses information that relates to:

  • a complaint made under the VI Act
  • an inspection made under the VI Act
  • an investigation conducted under the VI Act
  • a recommendation made by the VI under the VI Act
  • a report, including a progress report, on an investigation conducted under the VI Act

Making an FOI request to the Victorian Inspectorate

FOI requests must be in writing in the form of a letter, an email or a completed FOI application form.

The request should set out clearly the documents or information sought from the VI with enough detail to enable the VI to identify the relevant material and must include an application fee of $28.40.

The application fee of $28.40 can be paid by cheque or money order made out to the Victorian Inspectorate – please do not send cash. The VI will consider requests for waiver of the application fee in cases of financial hardship. Access charges may also apply once documents have been processed and a decision on access is made.

The types of documents that the VI creates and maintains include, but are not limited to:

  • audio-visual materials and transcripts
  • briefings and reports
  • case files
  • correspondence
  • financial records
  • human resource records
  • meeting records
  • policies, procedures and standards
  • registers
  • reviews

Statement 3: Freedom of Information arrangements

Under the FOI Act, members of the public have the right to request information and access documents about their personal affairs and the VI’s activities.

Access to document may be obtained through written request to the VI, as detailed in section 17 of the FOI Act. In summary, the requirements for making a request are:

  • it should be in writing
  • it should identify as clearly as possible which document is being requested
  • it should be accompanied by the appropriate application fee (the fee may be waived in certain circumstances)
