NOTICE OF DECISION

Owners Corporations Act 2006

As the Minister responsible for the Owners Corporations Act 2006, I give notice under section 12 of the Subordinate Legislation Act 1994 of my decision to recommend the making of the Owners Corporations Amendment Regulations 2026 (the proposed Regulations).

A draft of the proposed Regulations and an accompanying Regulatory Impact Statement (RIS) were released for public consultation on the Engage Victoria website between 5 November 2025 to 4 December 2025. In total 75 survey responses and 18 written submissions from the public, including from key stakeholders, were received.

After considering the feedback received as part of public consultation, the RIS and updated proposed Regulations were released for further public consultation on the Engage Victoria website from 27 March to 30 April 2026. Three written submissions were received as part of the second round of consultation: two from industry stakeholders and one from a consumer advocacy organisation.

Following detailed consideration of the feedback received, I have determined that the reforms to amend registration fees for individuals in charge of owners corporation (OC) management businesses introduced by the proposed Regulations will be progressed at this time. The proposed Regulations support the Victorian Government’s pricing principles by recovering the full costs of service provision to promote efficient consumption and ensure that fees applying to property professionals are measured against the same criteria.

In response to feedback contained in the submissions and surveys received in response to public consultation, the proposed Regulations include the following key update:

• Late lodgement fees have been amended to be set at cost recovery levels.

The Owners Corporations Amendment Regulations 2026 will come into operation on 25 November 2026.
