NOTICE OF DECISION

Labour Hire Licensing Act 2018

As Minister responsible for the Labour Hire Licensing Act 2018, I give notice under section 12 of the Subordinate Legislation Act 1994 of my decision to recommend the making of the Labour Hire Licensing Amendment (Construction) Regulations 2026.

The proposed Regulations and Regulatory Impact Statement were available for public consultation between 24 August 2026 and 21 September 2026.

A total of 10 submissions were received and considered.

After considering the submissions received, I have decided to recommend that the proposed Regulations be made without change, except with a later commencement date of 18 January 2027 to allow affected businesses sufficient time to transition. The proposed Regulations will prescribe individuals supplied to perform on-site security, traffic management and control, crane operation, and concreting activities as covered by the labour hire regulatory scheme.

After the proposed Regulations are made, they will be accessible to download from Victorian legislation | legislation.vic.gov.au

A copy of this notice and a Statement of Reasons summarising the issues raised in consultation through submissions and the rationale for the final form of the proposed Regulations will also be published on the Engage Victoria website at Labour Hire Licensing Amendment (Construction) Regulations 2026 | Engage Victoria

The Labour Hire Licensing Amendment (Construction) Regulations 2026 are proposed to come into effect on 18 January 2027.

The Hon. Colin Brooks MP

Minister for Industrial Relations
