Labour hire agency accused of not paying casuals long service leave

Wage Inspectorate Victoria has filed charges in the Magistrates’ Court of Victoria against Allstaff Australia RJE Pty Ltd (Allstaff Australia), alleging the labour hire company contravened section 9(2) of Victoria’s Long Service Leave Act 2018.

It is alleged Allstaff Australia failed to pay 5 former casual employees more than $32,000 in long service leave entitlements when their employment ended, despite them completing at least 7 years’ service.

The workers were employed by Allstaff Australia, then placed in various casual warehousing roles in other businesses, such as packer, store person and warehouse hand.

The maximum penalty for each offence is 60 penalty units for each day during which the offences continued.

The matter is listed for mention in the Industrial Division of the Magistrates’ Court in Melbourne on 15 August 2022.

The Wage Inspectorate will make no further comment while the matter is before the court.
