The Victorian Government — working with Victoria Police, the courts and other relevant stakeholders — trial and evaluate the use of agencies or service providers other than Victoria Police and court registrars to effect personal service of applications for family violence intervention orders.
The Department of Justice and Community Safety have identified a preferred alternative service provider and will embark on a 12-month trial in consultation with key stakeholders, to consider the scope of the trial, appropriate locations and training requirements.
Following the 12-month trial, there will be a formal evaluation of the success and viability of the alternative provider effecting personal service of applications for family violence intervention orders. This evaluation will inform a broader understanding of improved processes for both the Courts and Victoria Police.
The direction of further work on this initiative will be informed by the outcomes of reforms to the service requirements in the Family Violence Protection Act 2008 (Vic) (FVPA) including the implementation of Recommendation 57 which created new powers of the Magistrates’ Court of Victoria (Court) to make orders for the service of family violence intervention orders (including applications) to be effected by alternative service including electronic service by email. Other reforms that may inform the development of Recommendation 56 include the new powers of the Court to serve a respondent in Court where appropriate.
It is possible that these reforms made to the service requirements in the FVPA may reduce the burden on Victoria Police to the extent that an alternative service provider pilot may not be necessary. To that end, work is underway to monitor and assess the impacts of these reforms to determine whether there has been a reduction on volumes.
In parallel, consultation with key stakeholders including the Courts and Victoria Police is on foot to ensure that if such a trial is required, a suitable service provider is identified and provided with the relevant authorising environment and operational resources in which to implement the trial.
