Apply for a tobacco licence

You need a licence to sell tobacco in Victoria. Find out about the different tobacco licence types and how to apply.

If you sell tobacco in Victoria — either retailing to the public or wholesaling to other businesses — you must have a tobacco licence.

You can apply for your licence online through Service Victoria.

Who can apply

The applicant is who will hold the licence if one is granted. This may be different from the person completing the application form.

You can apply to hold a tobacco licence as a:

  • Body corporate – A company, incorporated association, or co-operative.
  • Natural person – An individual or sole trader.
  • Partnership – 2 or more people who own and run the business together.

The applicant must match the legal structure of the business. Learn more about business structures in the ‘Before you apply’ section of this page.

You cannot apply as an unincorporated association or trust. If you intend to operate your business under a trust, we will ask you for more information throughout the application.

*Fees on this page are for the 2025–26 financial year. Fee units are updated each year by the Department of Treasury and Finance.

You must pay the fee when you apply. You can pay by Visa, Mastercard or BPAY. Fees are not refundable, even if your application is refused.

After you apply

Once we receive your application and payment, we will review it to decide if you’re suitable to hold a tobacco licence. Submitting a licence application does not guarantee that you will be granted a licence.

We may:

  • contact you for more information
  • check details with Victoria Police or other government agencies, including interstate agencies.

Processing times will vary depending on the complexity of the application and other factors.

We will let you know the outcome of your application via email. We also notify Victoria Police and the relevant local council.

If you applied for a licence before 1 February 2026 and paid the fee, you can continue selling tobacco products while your application is assessed.

Once you submit your application, you’ll receive an email receipt showing when you applied. This is not your licence, but it proves you applied on time.

This email receipt can be shared with others if needed, like if a wholesaler or business asks if you are allowed to sell tobacco.

If your application is approved

If your application is approved, you must understand your obligations and follow the conditions of your tobacco licence.

If your application is refused

An application may be refused if:

  • the applicant, or their associates, is considered unsuitable
  • the applicant is legally disqualified from holding a licence
  • there is an error in the application, meaning it does not meet the requirements of the Tobacco Act
  • required information has not been provided.

If your licence application has been refused, you may apply again if:

  • the refusal was due to an administrative error, or
  • you have new or updated information that could change the decision.

There are no time limits for reapplying, but you will need to submit a new application and pay the fee again.

If a person or body corporate is disqualified from holding a licence, it cannot reapply until the disqualification period ends (which can be up to five years). A body corporate cannot apply if it or any director of the body corporate is disqualified.

Internal review

You can request an internal review if you disagree with a decision we have made to:

  • refuse a licence application, renewal application, variation application, relocation application, transfer application
  • vary a licence
  • suspend or cancel a licence
  • disqualify a person from holding a licence.

We will review the decision within 28 days and notify you of the outcome.

This review will either:

  • confirm the original decision
  • vary the original decision
  • make a new decision.

External review

If you’re not satisfied with the internal review result, you can apply to the Victorian Civil and Administrative Tribunal (VCAT).

You must apply to VCAT within 28 days of receiving the internal review decision.
