Eligibility
To be eligible to make a claim for compensation, you must:
- identify as Jewish;
- have been enrolled as a student at the college between 2015 and 2020; and
- have been impacted by antisemitism at the college.
Compensation
Financial compensation available
Eligible applicants can access:
- Baseline compensation of up to $24,000 ($4,000 per year of attendance between 2015 and 2020)
- Compensation for non-economic loss up to $60,000, subject to assessment of supporting evidence
- Compensation for medical expenses up to $5,000, subject to assessment of supporting evidence
External independent assessors will assess the appropriate amount of compensation based on the information provided by the applicant, including the required supporting evidence.
Non-financial compensation available
Eligible applicants can choose to participate in restorative engagement. Restorative engagement is a structured process involving one or both of the following:
- a personalised written apology from a senior departmental representative; and/or
- a meeting with a senior departmental representative to discuss your experience.
An external expert in restorative practices will facilitate the restorative engagement process.
Administration of claims
The department will process and manage all claim applications. It will liaise between applicants and the external independent assessors.
The external independent assessors have been selected in consultation with the Jewish Community Council of Victoria. The independent assessors are Justin Castelan and Fiona Ryan SC, who are barristers, and Associate Professor Peter Doherty, who is a medico-legal expert with expertise in psychiatry. Together, they have the expertise to make impartial, informed and fair decisions regarding eligibility and the appropriate amount of compensation to be paid.
Assessments made by the external independent assessors are independent and final. Their assessments will be communicated to the department for financial authorisation before being communicated to the applicant via Acceptance Form.
Required releases
A successful claim and payment of compensation will be conditional on applicants agreeing to release the department from all claims arising out of, or relating to, antisemitic conduct at the college between 2015 and 2020 (except to the extent that any such claims involve allegations of sexual abuse).
Applicants will be required to sign a deed of release prior to their claim being finalised and receiving compensation.

- Proof of identity – this may include a photocopy of a driver’s licence, passport or birth certificate.

- Statutory declaration – this must:
- Confirm that you identify as Jewish and experienced antisemitism at the college between 2015 and 2020; and
- If you seek compensation for non-economic loss, detail the harm suffered by you as a result of antisemitic conduct at the college between 2015 and 2020.
- If you are seeking compensation for medical expenses, the following evidence:
- receipt(s) for all claimed medical expenses and a statement from the relevant treating practitioner(s) or a statutory declaration attesting to the connection between those services and your experience of antisemitism at Brighton Secondary College between 2015 and 2020; OR
- a statement of Medicare benefits demonstrating the services in relation to which a claim is made and a statement from the relevant treating practitioner(s) or a statutory declaration confirming the amount claimed and the connection between those experiences and your experience of antisemitism at Brighton Secondary College between 2015 and 2020.
