Victoria's Long Service Leave Act 2018:

  • may not apply to employees who are covered by a federal award or workplace agreement – individual or collective – where that award or agreement contains its own long service leave provisions.
  • does not apply to employees who have their long service entitlement provided by another act or regulation – such as workers in building and construction, where it's provided by the CoINVEST scheme.

Before making a report, contact the Fair Work Ombudsman to determine whether an award or agreement applies instead of the Long Service Leave Act 2018.

If you believe you are owed a long service leave entitlement under Victoria's Long Service Leave Act 2018, you should ask your employer to pay your entitlement. If your employer refuses to pay and you believe the claim is under $20,000, you may wish to make a claim in the Industrial Division of the Magistrates' Court Victoria. Visit the Magistrates' Court of Victoria website for more information about making a claim and completing a letter of demand to give to your employer.
