Regulatory decision reviews

Request a review of a regulatory decision made by the Conservation Regulator.

If you are not satisfied with a regulatory decision made by the Conservation Regulator you can request a review of our decision.

Requests to review a regulatory decision must be submitted in writing.

Regulatory decisions include our decision to:

  • Issue, refuse, suspend, or revoke a wildlife licence, permit, or authorisation.
  • Issue, refuse, renew, or revoke a forest produce licence.
  • Amend the conditions of a licence, permit, or authorisation.
  • Require licence or authorisation holders to do specific actions to address issues identified by a Forest and Wildlife Officer. For example, by issuing a Directions Notice or Improvement Notice.
  • Issue sanctions, such as Official Warnings or enforceable undertakings.

Who can request a regulatory decision review?

You can request a review of a regulatory decision if:

  • You have applied for or been issued or refused a Conservation Regulator licence, permit, or authorisation and are dissatisfied with how we have applied the law or feel we have made an error.
  • You are not satisfied with our response to your Forest Report.
  • You have been authorised by an applicant or a licence, permit, or authorisation holder to act on their behalf.
  • You have been subject to enforcement action by the Conservation Regulator.

Step 1: Submitting a request to review a regulatory decision

When submitting a request to review a regulatory decision, we need you to supply some basic information, including:

  • Your contact details – we may need to call or email you regarding your request.
  • Details of your request – we need basic facts about the original decision and why you want it reviewed.
  • Preferred response – we want to know how you would like us to address your concerns.

Step 2: Acknowledging your request

After you submit your request, we will email you a reference number, a copy of your completed complaint details, and information about next steps.

Step 3: Reviewing regulatory decision requests

All information provided in a Request to Review a Regulatory Decision form must be true and complete. It may be an offence to false, misleading, or malicious statements. If we determine a request is false or misleading, we will take appropriate action.

Step 3a: Initial assessment

The Director responsible for the business unit that made the regulatory decision will assess your review request to determine if:

  • You have authority to request the regulatory decision review.
  • Additional information is required before the review can commence.

If the original decision was made by the Director, a different Director will be assigned to conduct the review.

All review requests, including those that we cannot progress, are recorded in the central register. We will notify you in writing that no further action can be taken.

Step 3b: Detailed review

The Director will consider the reason for your request, the details of the original decision, and relevant legislation. They may contact you to obtain further information. They may also gather and assess other relevant information or specialist advice as required.

The Director will determine whether:

  • The decision-making process was in accordance with the legislative requirements and the Conservation Regulator’s policies and procedures.
  • An error occurred, the reason for the error, and whether an assessment or decision should be redone.
  • Remedial steps are required to address and prevent the cause of the error happening again.
  • Any disciplinary action should be taken.

Step 4: Notifying you of the review outcome

We will notify you in writing of the findings of the review and the next steps to address the cause of your concerns.
